    Many years ago I was a witness to a similar incident. Some friends and I had been swimming and, in order to catch the bus to return home, it was necessary for us to cross a very busy main road. We approached the nearby crossing, and awaited the "green man". Now one of our group was listening to a personal stereo player, a device very popular at the time, and he was so engrossed in listening to the music that he crossed the road without ensuring it was safe to do so, and was hit by a car which, fortunately, was not travelling fast, as a result of which his injuries were very minor and he did not require hospital treatment. When his mother found out about the incident she did not consider whom she could sue. Indeed, she did not blame either the car driver, us (his friends) nor the manufacturer or retailer of the personal stereo, nor in fact anyone else, except her son for failing to look where he was going. Similarly, in the incident above, neither the girl nor her mother should blame the game, it's manufacturers' or retailers, nor any other third party for the unfortunate occurrence. The girl herself was to blame for failing watch where she was going. Deja vu?
