Nanny To Charge For Driving In The Rain


As loyal readers know, and often state, insurance companies are ever "keen" to reduce their requirement to payout when something goes wrong or charge the earth for "peace of mind".

Thus it should come as no surprise to learn that they have come up with a splendid wheeze, whereby driving when it rains will now be counted as a "risk" that requires insurance companies to increase their premiums on car insurance.

Easy money given the UK's weather!

So how will this little "wheeze" work then?

By using data from “black boxes” installed in cars that monitor speed, braking and acceleration; in order to score a driver based on their risk.

The technology, already offered by insurers Axa, Admiral, LV and Insure The Box, is about to start monitoring the weather. 
Ice, rain hail and snow will all be seen as risks, because the conditions are more likely to result in an accident.

The boxes will use data from The Weather Company, an American forecaster equivalent to the UK Met Office. The technology can create a "scoring algorithm" by assessing the conditions during a driver's journey.

All very well and dandy, except that:

1 Weather forecasts, even American ones, are generally crap.

2 People tend to need to drive in the rain for such mundane things as going to work, hospital, shopping etc etc.

At this point I can hear you ask, why get these black boxes?

Well at the moment they are voluntary, users are incentivised to have them for a discount to their premiums. However, I am very sure that in a few years' time once there is a critical mass of people with them, the insurance companies will insist on everyone having them.

All in all another means of making money out of those who are honest enough to insure their cars.

The Joys of Insurance


In this risk averse age I am always gemused that people, councils etc rush to insure themselves against all and sundry fates. Yet the insurance companies themselves do all they can to avoid paying out when misfortune strikes.

One would be tempted to ask what is the farking point of insurance?

On that note I was particularly gemused to read the terms and conditions of a travel insurance policy, specifically the very limited number of circumstances under which the insurance firm would pay out to cover costs if the trip were cancelled.

In essence there are very few circumstances under which the company would cover cancellation costs. However, they do generously cede that the death of the insured traveller pre departure is one circumstance that would justify payout for a cancelled trip!

Nanny Sells Medical Records For Pittance


Last week NHS England agreed to delay its medical record sharing project (Care.data) by six months, so that people could be better informed about its "benefits".

This delay prompted a backlash from various organisations (eg the BMA) accusing the NHS of backing down to scaremongering (whipped up by the media and various pressure groups) about the dangers of sharing data.

One week on and blinkey blonky blimey we see that the the NHS has been forced to admit that it has been wrongly sharing hospital admission data (from 1989 to 2010) with the insurance industry (the Institute and Faculty of Actuaries).

The information given to the Institute (in exchange for a nominal sum of £2,220) contained details on treatments and diagnoses, age, the area the patient lived in, but not their names. The information was used to produce a report to help insurance firms price their products.

The Health and Social Care Information Centre, which runs the database of records, said "greater scrutiny" should have been applied.

No kidding!

A spokeswoman for the Health and Social Care Information Centre is quoted by the BBC:
"The HSCIC believes greater scrutiny should have been applied by our predecessor body [the centre was known as the NHS Information Centre at the time] prior to an instance where data was shared with an actuarial society. 

We would like to restate that full postcodes and dates of birth were not supplied as part of this data and that it was not used to analyse individual insurance premiums, but to analyse general variances in critical illness.

We are absolutely committed to the public understanding what is being done with their information."
I wonder why the rules were not followed, and why the sum Nanny received was so small?

I don't know what annoys me more, the fact that Nanny shared the data with the wrong people or that she sold it for a pittance.

Either way this clearly shows that Nanny cannot be trusted with our data!

Too Old To Be Insured

My thanks to a loyal reader who pointed me in the direction of some Nanny insurance nonsense that prevented ex Royal Navy Albert 'Dusty' Miller (who served his country with distinction in World War Two) from acting as the Royal British Legion parade marshal (a role he has carried out for the last 38 years).

Seemingly he is now deemed to be "too old" to be insured!

That is always the way with insurance companies, they never like putting themselves at risk of "paying out". Given that Mr Miller put himself at considerable risk during his wartime service, one would have thought an exception could have been made .

Mr Miller was quoted by the Express:
"They came up to me and said, 'I've got a bit of bad news for you'. "At first I thought somebody had died and it was going to be another funeral. Then they told me HQ insisted I had to stand down as parade marshal. 

I said I was still fit and able, but they said it's because of insurance and that I should have stood down when I was 85.

It hit me like a ton of bricks. 

I was that disgusted I didn't know what to say. 

I've been a marshal for the Merseyside and West Lancs branch for 38 years. I never even knew standard-bearers had to be insured.
Insurance is very much a one way street when it comes to risk!

Nanny Bans Clock Winding



My thanks to a loyal reader who pointed me to some absurd Nanny nonsense concerning the goings on in Haworth (West Yorkshire) and its church clock at St Michael and All Angels Church, erected (can I say "erected" before 21:00?) in 1863.

For the last 23 years Jens Hislop has climbed the steps of the church several times a week to wind the clock.

Not anymore!

For why?

An insurance inspection declared that Mr Hislop’s stepladder and winding platform - which have been at the church for decades - were unsafe, and the clock has been stuck at 5:20 since February.

Mr Hislop cannot touch the clock again until £1,000 of safety work on the joinery has been carried out!

He is quoted by the Mail:
"I have been looking after the clock for 23 years and it has gone like clockwork. Then we had an insurance assessment and now health and safety has kicked in. 

I personally don’t think it is unsafe. But they say it’s dangerous. The clock is in perfect working order but has been stopped since February. It is crazy.

The platform is only 10ft off the floor and the wooden step ladder was here when I started 23 years ago and is no different now to what it was then."

Nanny Bans Sparklers



I trust and assume that you all had a pleasant and accident free Bonfire Night last night?

Our cat was remarkably relaxed about the whole affair, and the bangs and whistles around our house went off without causing any damage as far as I can see.

My commiserations to those who paid good money to attend public events where Nanny and the insurance companies did their best to put the mockers on it.

The Mail reports that the Round Table Group organised around 70 events across the country, where it seems that the health and safety/insurance rules had to be zealously applied wrt spectators not being allowed to bring in sparklers.

At one of the displays on Saturday night in Moseley, Birmingham, a large sign stated ‘Strictly no sparklers’ on site. Around 3,000 people attended, paying £5 for adults and £2 for children to enter. But anybody who attempted to light sparklers were told to extinguish them immediately.

Sigh!

In my day all manner of dodgy fireworks were freely available eg; jumping jacks, helicopters, bangers etc. Sadly many of these are now consigned to the dustbin of history, because they are deemed to be dangerous.

But sparklers???!!

OK, I admit that once I did mange to burn my hand on a dead sparkler; but that was my own stupid fault.

BTW, did anyone ever manage to get a jumping jack that actually worked satisfactorily?

Council Jobsworths

As we face many years (decades quite possibly) of austerity and cuts, where people in the real world will have to be flexible and creative in order to get by, it is refreshing to know that Nanny's council jobsworths remain as inflexible and pigheaded as ever.

As Charlotte Cubitt (a lady in her 80's living in Colchester) found to her cost recently, when she was trying to dispose of an old TV.

Mrs Cubitt, unsurprisingly, was unable to lift the TV herself and therefore decided to make use of the council's £11 removal service.

So far so good!

Can you guess what happened next children?

Yes, that's right, on contacting Colchester Borough Council Mrs Cubitt was told that staff could not enter her home and pick up the set.

For why?

Health and safety!

The "solution" offered to Mrs Cubitt was that she would have to carry the TV to the kerbside.

Errrmm...aside from the fact that she couldn't do that, in the event she had her neighbours do it for her wouldn't that lay her open to charges of "fly tipping" (with the associated fine)?

Oh, and supposing one of the neighbours injured themselves would that not lay her open to being sued by them?

Let us be clear, the issue "preventing" the council from providing a service for which they are charging is not health and safety, but their fear of an insurance claim.

As noted many times before on this site, "health and safety" is the excuse trotted out by feeble minded, lazy jobsworths who will not fight spurious ambulance chasing insurance claims (Factoid: insurance companies are conducting a nice little scam by selling details of claimants to ambulance chasing claim firms; the very same firms that the insurance companies accuse of pushing up the price of premiums!).

Councils and insurance firms are the enemy of the people!

New Balls Please - Nanny Bans Wimbledon

New BallsTis Wimbledon again and, as sure as eggs are eggs, the rain pisseth down.

I was therefore gemused to read that the rain (not unexpected during Wimbledon) caused the organisers of Wimbledon to turn off the giant TV screen on Murray Mount on Monday.

The reason cited being "health and safety", lest someone slip on the wet grass.

Now at which point I hear you all say "health and safety gone mad" etc etc.

However, my compliments and respect to Judith Hackitt, the chair of the Health and Safety Executive, who gave the Lawn Tennis Association a well deserved public spanking for using "health and safety" as an excuse.

She robustly pointed out that "there is nothing in health and safety legislation which prohibits the continued broadcasting of Centre Court action to the crowds on the hill during the rain. Health and safety is concerned with the proportionate management of real risks caused by work, not attempting to eliminate every minor risk from every moment of people's lives".

She then drove the point home by noting that the LTA should show some balls:

"If the LTA was concerned about people slipping and suing for their injuries, the message should have made clear the decision was 'on insurance grounds'."

As has been noted many times on this site, "health and safety" is used as the catch all excuse by unprofessional, lazy, jobsworths who are fearful of ambulance chasing insurance claims which they cannot be bothered to stand up and fight.

Good for Ms Hackitt!

Street Parties

Brown BottleI am glad to see that David Cameron and the government have their priorities right!

Of prime concern to Nanny is the fact that there are not enough street parties being organised, especially in the North, to celebrate the forthcoming Royal Wedding.

It seems that London will have more than 500 street parties, whilst Manchester and Newcastle will muster only 28 between them.

Nanny is urging councils to forget about licences, insurance and other red tape so that people could "get on and have fun", as the Prime Minister put it.

That just shows how little the government understand how local councils operate. The councils have no intention of abandoning the red tape, they hate public events like this and will do all they can to hinder them.

My own local council, Brighton (Tory run), refuses to publicise where our street parties (over 20 of them) will be held.

For why?

They claim that they don't want people coming to these events uninvited!

Hello!!!

Isn't that the whole farking point of a street party??

Anyhoo, aside from council bureaucracy there are also two other reasons why there are fewer "organised" parties in the North:

1 It is wet at this time of year there.

2 The locals despise their councils even more than we do down South. Therefore, there is not a cat's chance in hell they will tell their councils that they are organising a party.

Confusion Abounds!

As Guy Fawkes (Bonfire) night draws near, it should come as no surprise at all to hear that Nanny has being doing her best to make a damp squib of the whole event (as per normal).

Members of the Somerset County Guy Fawkes Carnival Association, who have been trying to organise the celebrations, have hit a few problems when it was discovered that our "old friends" from the world of insurance were unwilling to accept the heavy trailer floats.

For why?

The insurers were of the view that the drivers needed a heavy goods licence.

The organisers enlisted the help of Avon and Somerset police, and submitted an application for exemption to the DVLA and the Department for Transport (DfT).

You see folks the DVLA regulations ban agricultural licence holders from driving agricultural vehicles towing trailers weighing more than 7.5 tonnes, unless they are performing agricultural work.

The carnival floats exceed limit and are pulled by tractors.

Haha!

Fear not though, the DfT have checked the rules and responded that the rules do not ban provincial carnivals using such means to haul their floats around. It seems that the information on the DVLA website is just overly confusing!

A spokesman for Avon and Somerset Police said the dispute was the result of "confusion all round", and said they will work harder next year will everyone to ensure that they have a greater clarification of the relevant legislation.

Ho Hum!

So much time, effort and money wasted all because the information provided by Nanny was confusing.

It seems to me that many of Nanny's "rules" and "regulations", that are happily quoted by those who wish to stop people living their lives, are in fact non existent.

Nanny deliberately makes things confusing in order to make people avoid doing things, lest they break the law.

Oh, and by the way, I guarantee that many London councils will do their best to use the upcoming fire service strike in London as an excuse to stop firework display etc.

I am well pleased to see that Lord Young of Graffham has issued a report (as commissioned by David Cameron) that condemns ambulance chasing lawyers, and calls for curbs on the the aggressive advertising used by these lawyers.

Lord Young is of the view that members of the public are encouraged by unscrupulous lawyers to pursue frivolous personal injury and negligence cases, while "well-meaning" people are deterred from organising voluntary activities.

He notes that the industry has created a "particularly pernicious" climate of fear that puts off well-meaning members of the public from organising voluntary activities in case they are sued if an accident happens.

Lord Young said:

"People who seek to do good in our society should not fear litigation as a result of their actions."

Needless to say, the Association of Personal Injury Lawyers doesn't like Lord Young's conclusions.

This organ has released a statement claiming that changes to health and safety legislation will result in a culture of "carelessness and injury".

Nanny To Ban Health And Safety?


I am pleased to see that Lord Young of Graffham, tasked with reviewing health and safety rules, holds the health and safety rules which prevent the police and rescue services from actually rescuing people in as much contempt as the rest of us do.

He told the Times that the emergency services were "paid for doing a job that involves risk" and legislation should not be "an excuse for inaction".

He also holds seems to hold the compensation culture, and ambulance chasing "personal injury" lawyers in absolute contempt.

Good!

Muiris Lyons, president of the Association of Personal Injury Lawyers, postulated to the BBC the rather bizarre theory that personal injury lawyers want to see accidents reduced:

"Our organisation is all about trying to reduce the incidents of injuries and I'm sure there is common ground there [with the review].

But where people are needlessly injured, through others' fault, they should be able to obtain access to justice
."

How exactly does a cash payment bring someone back from the dead, or heal a broken leg (which will have already been attended to by the NHS)?

I will follow the progress of Lord Young's review, and its actual tangible outcomes, with interest.

I do not doubt Lord Young's integrity, nor his desire to end the worst excesses of the Nanny state. However, he has an uphill battle as there are many vested interests who will do their utmost to keep their petty dictatorships and small minded rules going.

A Green Shoot of Commonsense or A Little Weed?



Could it be, albeit in the first days of a "fresh" government, that we are witnessing a green shoot of commonsense?

The government says that it wants to review health and safety laws, in order to check the "growth of compensation culture".

Lord Young will be leading the study, and wants advertisements for personal injury claims firms to be banned.

Unsurprisingly ambulance chasing lawyers (who earn fat fees from insurance settlements) have responded by saying that "compensation culture" is a "myth".

Well they would say that wouldn't they?

Unfortunately, as loyal readers of this site know, the issue runs deeper than a specific piece of legislation banning a particular activity.

The disease of risk aversion and health and safety runs so deep in the body of our country, and the minds of the jobsworths (to whom we give excessive powers), that people make their own "interpretations" of the law (even if the law is actually not in place) and ban whatever takes their fancy on the grounds of "health and safety"/risk.

The issue lies in the mindset of the jobsworths (councils, teachers, bureaucrats etc) who set the bans, and the sheeple who allow them to get away with it.

It will take more than a review by Lord Young to change that mindset.

Prats of The Week - Sainsburys

Prats of The WeekAha my loyal readers, tis time again for another of my internationally renowned and prestigious "Prats of The Week" Awards.

This time, not for the first time though, it goes yet again to Sainsbury's.

John Wilkinson, a customer of Sainsbury's, has every reason to believe that Sainsbury's are prats.

For why?

He went shopping the other day, for a lamb joint, in his local Sainsbury's in Cardiff.

He was happily chatting to the in store butcher there, who had been in the profession for 30 years, about meat related issues and how the butcher had been training new apprentices wrt cutting joints and meat.

So far so good!

Anyhoo, the lamb joint was duly presented and Mr Wilkinson then asked the butcher to de-bone it.

Can you guess what happened next?

Yes, that's right, the butcher said he could not de-bone it.

For why?

There was a risk that he might cut himself during the process, and that as he wasn't insured Sainsbury's wouldn't let him cut the joint.

A spokesman for Sainsbury's told The Mail:

"Our colleagues who work on the meat counters are all trained to use knives, but some have not received all of the training to safely de-bone a lamb joint".

Thirty years in the profession, I am sure that butcher has tackled a lamb joint at least once in his life!

Lawyers Cancel School Trip II

LawyersThose loyal readers with long memories, not addled by Nanny's banned substances of booze and fags etc, may recall that back in January I wrote about the rather sad story of a school trip to an outdoor activity centre in Craggan in the Cairngorms being cancelled because the mother of a disabled girl objected to it.

Yesterday one of the other parents (who by happenstance I knew at university), who has a child at the school, posted an update on the article:

An update from a parent of a child at the school.

Highland Council have now created a trip to another outdoor centre but the mother of the disabled child has removed her child from the school in protest. The mother claims NO child should be allowed to enjoy ANY activity her severely disabled child cannot take part in. That is NOT the law and is unfair, in that it would restrict options for able bodied children.

The action of Highland Council in giving way is very odd. We have not had an explanation of why the council felt it had "no alternative" but to cancel the trip. I have requested details (under Freedom of Information rules) of which clause in the Disability Discrimination Act was not complied with or which section of the Council's "Trip Planning Guide" was not followed.

I suspect that the "guidance" was not fully followed so they felt nervous. I have suggested that such guidance "gold plates" the DDA and makes it easier to challenge a trip.

I am at a total loss to understand the rationale behind this woman's actions.

It is a very sad story, and one that reflects quite how dysfunctional our society has become under the weight of legislation and climate of fear generated by the Nanny state.

It's The Money Stupid!

It's The Money Stupid!My commiserations to the bus driver who works for Ellie Rose Travel Limited, a Hull based bus company, who had the misfortune to be driving a school bus with a right little brat on on board.

The 12 year old brat was taking the bus to school, last October, and misbehaving. She was clambering on the luggage rack whilst the bus was in motion. Despite being warned by her school mates and the driver that this was stupid, she continued to do it.

Can you guess what happened next loyal readers?

Yes, that's right, she and another brat who was arsing about with her fell through the window of the single decker bus.

No serious injuries were suffered.

End of story?

Not quite!

Can you guess what is happening now?

Yes, that's right, one of the brats has instructed a solicitor (really? Bit young to be "instructing" solicitors aren't they?) who specialises in personal injury cases to prepare a claim for damages.

Jim Houghton, owner of Ellie Rose Travel, is quoted in the Mail:

"I am not surprised someone is trying to sue us. It's the way things are these days, which upsets me.

The parents of the other girl who fell out said they didn't want to take the matter any further
."

Ellie Rose Travel withdrew the school service shortly after the incident, so now all the kids have to find other means of getting to school.

Gosh, here's a thought, how about walking?

Cynics might suggest that the parents of the brat making the damages claim are hoping to make a nice little windfall here.

Lawyers Cancel School Trip

RumpoleI was sad to read recently that Highland Council cancelled Crown Primary School's (from Inverness) annual trip, because they were afraid of being sued for excluding a disabled child from the trip.

The Equality and Human Rights Commission wasn't much impressed either, and said that the action was short sighted.

Normally the school stays at an outdoor activity centre in Craggan in the Cairngorms. However, Donna Williamson said that her daughter was physically unable to take part in the activities planned. Therefore, fearing legal action, the council cancelled the trip for everyone.

Quite how cancelling the trip helps the children of the school I fail to see.

Nor do I think that they have made the daughter of Ms Williamson terribly popular (even though she is blameless) with her class mates for this.

The concept of integration etc works both ways. By all means do your utmost to help include people. However, inclusion is not helped by banning activities that not all can take part in.

The child will now feel thoroughly miserable for being the unwitting cause of this.

The council are gutless, as their actions indicate that they could not be bothered to try to withstand a speculative legal challenge on this matter.

Sometimes you do have to stand up for what you think is right, even if some lawyer says that you will lose.

Bonfire of The Numpties

FireworksHere we are again folks, tis Guy Fawkes night!

Hoorah!

As expected, Nanny's anti firework and anti bonfire brigade are doing their level best to put the mockers on this fine event (celebrating a really bright bloke who wanted to get rid of all the politicians of his day!...that's the idea isn't?).

I am sad to see that the year on year negative publicity spewed out by Nanny has so worn down the organisers at Ilfracombe Rugby Club, that they can't even be bothered to ask their council for permission to have a bonfire.

Instead, put off by the "mountain" of paperwork and regulations set by council chiefs, they have opted to have a "virtual" bonfire!

Seemingly a real fire would have required five qualified fire marshals, and metal barricades to keep people at a safe distance.

The "virtual" bonfire will use giant heaters, lighting, sounds of crackling wood and a smoke machine to give the impression of a fire.

There will at least be some real fireworks (this year anyway).

So ends another fine British tradition, worn down by endless paperwork and nit picking bureaucracy.

Potty!

PottyPhillip Darnton, chief executive of Cycling England, an agency funded by the Department for Transport (DfT) to promote cycling, recently came up with a particularly "potty" idea.

He wants changes made to road rules that would make the driver of the most powerful vehicle involved in a collision automatically liable for insurance and compensation in civil law.

Therefore if a car hit a cyclist, the presumption of blame would fall on the driver, while a cyclist would automatically be blamed if they knocked down a pedestrian.

All very well, if the fault lies with the driver of the "most powerful vehicle". However, what about cases where the cyclist or pedestrian is clearly at fault?

There are more than one or two cyclists who happily ride down one way streets the wrong way, or jump red lights. Not to mention certain idiotic pedestrians who jump out into the road on the assumption that a car or cycle can stop within a nano second.

This scheme, were it ever to be adopted, would provide a charter for every insurance scam merchant in the country.
